Estate planning in 2026 can now be a lot easier than you'd think. Gone are the days of having to sit in an attorney's office for a standard estate plan. Attorneys still have a seat at the table, but for a lot of families, it can be easier.

We partnered with EncorEstate Plans so we can handle the whole process for you, and an independent attorney reviews your documents. The ClearMind Legacy Plan is $1,500 per household, single or married, or $1,200 if you don't own a home. The brochure has all the information you need.

    Sign your agreement and pay your fee, and we send you our preparation kit.

  2. Legacy Plan meeting

    We walk through the five big decisions together and enter your choices.

  3. Review

    Your documents come back in one to two weeks, reviewed by an independent attorney. We go through every page and the attorney's letter with you.

  4. Sign and fund

    Sign at our office with a notary and witnesses, then we help retitle your accounts.

Before anything comes back to you, Encore's estate planners and paralegals check each plan with a 60-point review. Encore also arranges your attorney review and prepares and records your deed with the county.

What is the ClearMind Legacy Plan?+

It's a trust-based estate plan we build with you. Your documents are generated through EncorEstate Plans, an independent attorney licensed in Ohio reviews them before you sign, and we handle the meetings, the signing, and moving your accounts into the trust.

How much does the Legacy Plan cost?+

$1,500 per household, single or married, or $1,200 if you don't own a home. It's paid when you sign up and covers your documents, the attorney review, your deed, and every meeting with us. Extras like an additional Ohio property or a separate trust for each spouse are priced separately, and only added with your okay. The Legacy Plan fee is separate from our advisory fee.

Is ClearMind Capital a law firm?+

No. ClearMind Capital and Encore are not law firms and do not give legal advice. The reviewing attorney works independently of us, and the review covers your finished documents. You're welcome to bring in your own attorney at any point.

Do I need a trust or a will?+

Both get your assets to the people you choose. Assets titled to a revocable living trust usually skip probate and stay private. A will works through probate court, and a probated will becomes a public record. A trust is often worth considering if you own a home, have minor children, or want inheritances released in stages. If you rent, have no minor children, and most of your money sits in retirement accounts and life insurance with current beneficiaries, a will-based plan can work well. Which fits depends on your situation, and an estate planning attorney can advise you on the choice.

Does a revocable living trust lower my taxes?+

No. A revocable trust doesn't reduce income or estate taxes or shield assets from your creditors. Ohio repealed its estate tax for deaths on or after January 1, 2013, and the federal estate tax exemption is $15,000,000 per person for 2026. If you're close to that, talk with an estate planning attorney about planning beyond a revocable trust.

How long does it take?+

Most plans go from first call to signed in four to eight weeks.

What happens after I sign?+

Your trust has to be funded, which means retitling assets or naming the trust as beneficiary. Your Ohio home deed is included and recorded for you. We retitle the accounts we manage and give you a checklist for the rest, since a trust only controls what's titled to it or payable to it.

When would you send me to an attorney instead?+

If you need an irrevocable trust, Medicaid planning, or advanced estate tax planning, we'll refer you to an estate planning attorney. If your situation needs one for any other reason, we'll tell you.
